Teleworking was previously an incentive measure; it is now mandatory from 3 January and for 3 weeks. Focus on what you need to know about this new measure.
How many teleworking days per week?
Announced by Jean Castex on December 27, the health protocol published a few days later states that “employers set, as of January 3 and for a period of three weeks, a minimum number of three days of teleworking per week, for positions that allow it”. It is specified that when conditions permit, this number can be increased up to 4 days.
Invited on FranceInfo, the Minister of Labor, Élisabeth Borne, affirmed that these three days were an “average” at the level of the company and not of each employee. “Some can do more, others less,” she clarified.
What are the sanctions for non-compliance with teleworking?
Businesses that don't play the game could face hefty fines. In fact, the Minister of Labor announced that an amendment to the draft law on the vaccination pass would be introduced “by providing for the possibility for the labor inspectorate to impose sanctions of up to 1000 euros per employee whose situation is not in conformity, within the limit of 50,000 euros.”
According to the minister, before the vacations, 60% of employees whose positions could be teleworked were actually teleworking. In order to increase this percentage, the number of inspections by the Labour Inspectorate should increase from 1000 to 5000 per month.
